Buyers and sellers communicate directly, and the Company does not act as a broker, agent or intermediary, nor does it charge commission on transactions concluded between users.

The Company provides a professionally moderated online marketplace for machinery, equipment and components serving the mining, construction, earthmoving, transport, agriculture, forestry, quarrying and related industries.

3. Acceptance of these Terms

By accessing the Website, registering an account, purchasing an advertising package, submitting an advertisement for moderation or using any service provided by Africa Machinery & Equipment (Pty) Ltd, you agree to these Terms of Use and all applicable laws of the Republic of South Africa.

4. Marketplace Scope

5. Advertising Packages, Submission and Moderation

Advertising on the marketplace requires the purchase of an applicable advertising package. After payment has been successfully received, advertisements are submitted for moderation. Moderation is the process by which Africa Machinery & Equipment (Pty) Ltd assesses advertisements for compliance with these Terms, advertising standards and marketplace policies before publication.

6. Advertisement Standards and Submission Requirements

To maintain a professional, trusted and high-quality marketplace, every advertisement submitted to Africa Machinery & Equipment (Pty) Ltd must comply with the Company’s advertising standards and submission requirements. These standards assist in maintaining the integrity of the marketplace and improving the quality of advertisements presented to prospective buyers.

• Each advertisement must relate to one individual item only.
• Advertisements must be submitted under the most appropriate category and region.
• Descriptions must accurately represent the machinery, equipment or component being advertised.
• Advertisers should provide complete specifications wherever possible.
• Original photographs of the advertised item are strongly encouraged.
• Where available, original videos of the advertised item are encouraged.
• Advertisers are encouraged to include their company logo or watermark on images to identify ownership and reduce unauthorised reuse.
• Images, videos and descriptions must accurately represent the advertised item.
• AI-generated or heavily manipulated images that materially alter the appearance, condition or specifications of the item may result in the advertisement being rejected during moderation.
• Duplicate advertisements or advertisements submitted in multiple categories for the same item may be rejected.
• Advertisements containing misleading, false, unlawful, defamatory or unrelated content will not be accepted.
• Africa Machinery & Equipment (Pty) Ltd reserves the right to request amendments before publication where necessary.

7. Advertisement Moderation and Publication

Every advertisement submitted to Africa Machinery & Equipment (Pty) Ltd is submitted for moderation before publication. Moderation is undertaken to ensure compliance with these Terms of Use, the Company’s advertising standards and the overall purpose of the marketplace.

Advertisements are generally moderated within 24 to 48 hours, excluding weekends and recognised South African public holidays. Where additional information is required, the moderation process may take longer.

• Submission for Moderation does not guarantee publication.
• Advertisements may be approved, declined or returned to the advertiser for amendment.
• Advertisements unrelated to the industries served by the marketplace may be rejected.
• Advertisements that appear fraudulent, misleading or intended to abuse the marketplace may be rejected without publication.
• Draft advertisements remain unpublished until the appropriate advertising package has been purchased and payment has been successfully received.

8. Website Publication and Advertisement Exposure

One of the distinguishing features of Africa Machinery & Equipment (Pty) Ltd is its commitment to maximising the visibility of approved advertisements.

As part of the standard advertising service included with every approved listing, Africa Machinery & Equipment (Pty) Ltd utilises the digital channels available to the Company to maximise the visibility of approved advertisements throughout Africa.

The Company uses the information, photographs and videos supplied by the advertiser within the approved listing when promoting that advertisement. Advertisers are therefore responsible for ensuring that all submitted content is accurate, complete and suitable for publication.

The digital channels used by the Company may include the online marketplace, search engines, newsletters, social media platforms and other digital platforms available to the Company. The platforms and methods used may evolve over time as the marketplace continues to grow.

Africa Machinery & Equipment (Pty) Ltd does not guarantee enquiries, sales, response times or a specific level of exposure, but remains committed to maximising the visibility of approved advertisements using the resources available to the Company.

9. Newsletter and Advertising Opportunities

Africa Machinery & Equipment (Pty) Ltd distributes a regular newsletter containing marketplace updates, industry news and selected advertising opportunities. Advertising space within the newsletter is separate from standard listing packages and is subject to availability, approval and separate pricing. Registered users may receive newsletters and marketing communications in accordance with the Privacy Policy and may unsubscribe at any time.

10. Affiliate Programme and Sales Representatives

Africa Machinery & Equipment (Pty) Ltd operates an Affiliate Programme through authorised Affiliates and Sales Representatives.

• Each authorised Affiliate or Sales Representative receives an official Company tracking link.
• Users introduced by an Affiliate are encouraged to use that official tracking link when registering or purchasing advertising packages.
• Only official Company-issued tracking links are recognised for commission purposes.
• Anyone claiming to represent Africa Machinery & Equipment (Pty) Ltd should be able to provide an official Company-issued tracking link.

11. Fees, Payments and Payment Security

Advertising packages are purchased online. Advertisements proceed to moderation only after payment has been successfully received. Payments are securely processed through PayFast and may require 3D Secure authentication where applicable. Advertising fees are non-refundable unless otherwise required by the laws of the Republic of South Africa.

12. Scope of Services and Marketplace Limitations

Africa Machinery & Equipment (Pty) Ltd operates exclusively as a professionally moderated online marketplace for the advertising of machinery, equipment, components and related products.

The services provided by the Company are limited to the advertising packages and services published on the Website.

The Company and its authorised representatives do not offer, facilitate or undertake brokerage services, sales representation, intermediary services, buyer sourcing, seller sourcing, transaction negotiations or commission-based sales arrangements. These services do not form part of the Company’s business model and are not available through the marketplace.

Accordingly, users may not request the Company or its authorised representatives to:

• Personally market or sell machinery or equipment on their behalf.
• Source buyers or sellers outside the normal operation of the marketplace.
• Negotiate transactions.
• Act as brokers or intermediaries.
• Enter into commission, referral or success fee arrangements.

13. Confidentiality of User Information

• Only advertise machinery they are authorised to advertise.
• Comply with applicable laws.

16. Limitation of Liability

Africa Machinery & Equipment (Pty) Ltd provides a professionally moderated online marketplace and advertising service. The Company does not guarantee enquiries, offers, sales or commercial success and is not responsible for disputes or losses arising from transactions between users.

17. Suspension and Termination

The Company may refuse, suspend or permanently terminate access to the marketplace or remove advertisements where these Terms are breached or the integrity of the marketplace is compromised.

• Misleading or fraudulent advertisements.
• Attempts to circumvent published services or pricing.
• Requests for confidential user information.
• Abuse of the moderation process.

18. Privacy

19. Governing Law
